It is my responsibility to consult a physician before participating in this or any fitness program and I affirm that I have no medical conditions that would restrict me from participating in any of the fitness services. I agree that participation in this event is not a replacement for medical care and that if I do experience medical issues, I will contact my doctor immediately. If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid. Then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from. I have read the above HEROES RUN Waiver fully and I understand and agree to its contents. I authorize HEROES RUN to use my photo as well as any media, photos, or footage solely for the purpose of marketing. We reserve the right to cancel/extend the Race for reasons attributable to Covid-19. If the Race must be cancelled for reasons attributable to the applicable Covid Rules, the Organizers has no obligation to refund the registration fee to you or pay damages or any other compensation. We will still send the race kits. I understand that the registration is non-refundable and non-transferrable. This agreement releases the City of Cebu and the organizers from all liability relating to injuries that may occur engaging Active Hub and other organizers of the event. By signing this agreement and registering for the HEROES RUN I agree to hold organizers entirely free from any liability, including financial responsibility for injuries incurred, regardless of whether injuries are caused by negligence. I also acknowledge the risks involved in this event. These include but are not limited to sprain, fracture, neuromusculoskeletal injuries and other physical and mental injuries. I swear that I am participating voluntarily and that all risks have been made clear to me. Additionally, I do not have any conditions that will increase my likelihood of experiencing injuries while engaging in this activity. By signing below I forfeit all right to bring a suit against the organizer for any reason. In return, I will receive full service from the organizers. I will also make every effort to obey safety precautions as listed in writing and as explained to me verbally. I will ask for clarification when needed. *

The Event may be postponed, shortened or extended by us at our sole discretion. Upon such postponement or variation to the Event duration, we shall notify you as soon as practicable. We reserve the right to change the event dates by notifying you as soon as practicable. No refunds shall be entertained. We will send you your race kits. *

We reserves the right to refuse entry by any Participant to an Event or to remove any Participant from an Event without any liability if, in its sole discretion, it determines that such Participant’s presence a disruption at the Event, to threaten the safety of other attendees or to hinder the enjoyment of the Event by other attendees, without prejudice to any other rights or remedies available to the organizers. *

We are not be responsible for any delay, damages, loss, increased costs and/or other unfavourable conditions directly or indirectly arising by virtue of any Force Majeure Event. If the Event is directly prevented by a Force Majeure Event for more than seven (7) consecutive calendar days, the Event maybe cancelled or postponed by us at our sole discretion . A “Force Majeure Event” shall mean any cause beyond our reasonable control, including without limitation, fire, flood,illness, pandemic (as declared by World Health Organisation), earthquake, explosion or accident,blockade, embargo, inclement weather, governmental order, decree, restraints or regulation, restraints or orders of civil defence or military authorities, war, riot or civil disturbance or commotion, sabotage, act of terrorism, strike, lockout, boycott or other significant labour dispute or disturbance, absence of premises required for the Event, and the abovementioned scenarios shall include any threat thereof. We will send you the race kits. *
